9.21 SMOKING PROHIBITED ON CERTAIN PREMISES (Cr. Ord. 1848 –
7/6/87).
(1) ADOPTION OF CLEAN INDOOR AIR ACT. §101.123, Wis. Stats., is
hereby adopted by reference to define offenses against the health, welfare and peace of the
City.
(2) TOBACCO USE PROHIBITED BY OWNER (Rep. & Recr. Ord. #1998 –
7/23/90). No person shall, without the permission of the owner or lessee of any public or
private property, use tobacco products thereon contrary to a posted sign if such sign is in
plain view on the property or at the entrances to the property.
(a) Owners and lessees of
property may prohibit, restrict or limit smoking on their property in their discretion.
(b) The restrictions imposed by this subsection are in addition to the
restrictions imposed by sub. (1) above and apply to unenclosed as well as enclosed areas.
(3) PENALTY (Am. Ord. #1998 – 7/23/90). Any person who uses tobacco products
in violation of sub. (1) or sub. (2) above shall be subject to a penalty as provided in sec. 9.30
of this chapter.
(4) DEFINITION (Cr. Ord. #1998 – 7/23/90). In this section, "use tobacco
products" or "use of tobacco products" includes smoking, as defined in §101.123, Wis.
Stats., and chewing, carrying in the mouth or consumption of tobacco or a product
containing tobacco.
